WESLEAF TERMS & CONDITIONS

Welcome to Wesleaf. These Terms & Conditions (“Terms”) govern your use of the Wesleaf website, purchases, bookings, registrations, rentals, services, events, workshops, wellness experiences, and other offerings provided by Weslie Etienne LLC DBA Wesleaf (“Wesleaf,” “we,” “us,” or “our”).
By accessing our website, making a purchase, booking a service, registering for an event, renting our space or products, or otherwise engaging our services, you agree to these Terms.
1. Wesleaf Services
Wesleaf is a plant boutique, design studio, event and rental provider, and botanical wellness space based in Medford, Massachusetts.
Our offerings may include retail plants and merchandise, interior plant design, plant rentals and staging, plant maintenance, repotting and consultations, corporate gifting, workshops, private events, studio rentals, Wesleaf Mind & Body programming, wellness experiences, educational programming, and other botanical or community experiences.
Specific services may be subject to additional proposals, invoices, rental agreements, waivers, or event-specific terms. If those terms conflict with these general Terms, the terms of the specific written agreement will control for that transaction.
2. Retail & Plant Purchases
Live plants are natural products and will vary in size, shape, color, fullness, growth pattern, and appearance. Photographs are representative and do not guarantee that an individual plant will look exactly like the plant pictured.
Customers are responsible for determining whether plants are appropriate for their home, workplace, pets, children, and environmental conditions.
Plant-care information provided by Wesleaf is educational guidance based on general plant-care practices. Plant health cannot be guaranteed after purchase because light, watering, humidity, temperature, pests, handling, and other environmental conditions are outside Wesleaf’s control.
3. Pricing & Payment
Prices are displayed in U.S. dollars unless otherwise stated.
Applicable taxes, delivery charges, shipping charges, installation fees, service fees, or other costs will be disclosed as applicable before purchase or within a service proposal or invoice.
Massachusetts regulations require businesses advertising prices to consumers to clearly disclose the total price, including mandatory fees, subject to specified exceptions. Massachusetts Government
Payment is required according to the terms presented at checkout, registration, invoice, proposal, or service agreement.
Wesleaf reserves the right to correct pricing or description errors and to cancel or refund transactions affected by an obvious error.
4. Returns, Exchanges & Live Plants
Because live plants are perishable living products, all live plant sales are generally final unless otherwise stated at the time of purchase.
Non-living merchandise may be eligible for return or exchange according to the return policy communicated at purchase.
Custom orders, special-order plants, personalized products, custom botanical designs, installed materials, event designs, and other made-to-order items may be non-refundable once sourcing, purchasing, production, or preparation has begun.
Nothing in this policy limits rights that cannot legally be waived under applicable consumer-protection law.
5. Orders, Pickup, Delivery & Shipping
Customers are responsible for providing accurate contact, delivery, and shipping information.
Delivery and installation require safe and reasonable access to the property or venue. Additional costs resulting from inaccurate information, inaccessible locations, parking restrictions, excessive wait times, venue requirements, or changes to previously disclosed conditions may be charged to the customer where agreed or otherwise permitted.
For merchandise ordered online for shipment, Wesleaf will provide applicable shipping expectations. Federal rules generally require online sellers to have a reasonable basis for promised shipping times and provide consumers with options when qualifying delays occur. Federal Trade Commission
6. Events, Workshops & Wesleaf Mind & Body
Wesleaf hosts educational, creative, movement, wellness, and community experiences through Wesleaf and Wesleaf Mind & Body.
Event descriptions will identify applicable pricing, age requirements, equipment, attire recommendations, or other participation requirements.
Unless otherwise stated, event registrations are for the registered participant and are subject to the cancellation and transfer policies stated on the event listing.
Wesleaf reserves the right to reschedule, modify, relocate, substitute a facilitator for, or cancel an event when reasonably necessary. If Wesleaf cancels an event entirely, registered participants will receive the applicable refund, credit, or alternative communicated for that event.
7. Wellness & Physical Activity Disclaimer
Wesleaf Mind & Body experiences may include Pilates, yoga, walking, stretching, fitness, meditation, breathwork, sound experiences, and other wellness activities.
Participation is voluntary.
Participants are responsible for determining whether they are physically able to participate and should consult an appropriate healthcare professional before participating when necessary.
Wellness programming offered through Wesleaf is intended for general wellness, educational, and recreational purposes and is not a substitute for individualized medical advice, diagnosis, treatment, physical therapy, mental health treatment, or other licensed healthcare services.
Participants should stop participating and seek appropriate assistance if they experience pain, dizziness, difficulty breathing, or other concerning symptoms.
Certain activities may require participants to sign a separate waiver before participating.
8. Independent Facilitators & Practitioners
Some Wesleaf experiences are led by independent instructors, educators, practitioners, speakers, or other third-party professionals.
Unless expressly stated otherwise, these individuals are not employees of Wesleaf and may be independently responsible for their professional services, credentials, advice, representations, and conduct.
The inclusion of a practitioner or speaker in Wesleaf programming does not constitute medical or professional endorsement of every statement, product, service, or recommendation they may provide.
9. Private Event & Studio Rentals
Private studio rentals are subject to Wesleaf’s separate rental terms and rental agreement.
Event liability insurance may be required. When required, renters must provide a Certificate of Insurance meeting Wesleaf’s requirements and naming Weslie Etienne LLC DBA Wesleaf as an Additional Insured by the specified deadline.
Renters are responsible for their guests, vendors, contractors, entertainment, and invitees.
No decorations, signage, equipment, lighting, or other materials may be attached to Wesleaf walls, ceilings, doors, windows, fixtures, plants, or other surfaces without prior written approval. Décor must be freestanding unless Wesleaf expressly approves otherwise.
Glassware and other breakable event materials are prohibited unless Wesleaf provides written approval.
Open flames, fireworks, pyrotechnics, smoke devices, loose glitter, loose confetti, colored powders, and materials that may stain, damage, contaminate, or create excessive cleanup are prohibited.
Renters may be charged for damage, loss, excessive cleaning, unauthorized alterations, or other costs caused by the renter, guests, or vendors.
10. Plant Rentals, Staging & Event Design
All rented plants, planters, vessels, décor, and equipment remain the property of Wesleaf unless expressly sold to the customer.
Rental plants may not be watered, fertilized, repotted, pruned, decorated, relocated, altered, or removed without Wesleaf’s permission.
Because plants are living products, exact varieties, sizes, shapes, and vessels are subject to availability. Wesleaf may make reasonable substitutions of comparable style, scale, and value when necessary.
Clients are responsible for rented property from completion of installation or delivery until retrieval by Wesleaf.
Rental pricing does not establish or limit replacement value. Items lost, stolen, destroyed, or damaged beyond reasonable repair may be charged at their applicable replacement cost, including the plant, planter or vessel, materials, sourcing, procurement, transportation, and labor.
11. Consultations & Plant Care Services
Plant consultations, recommendations, repotting, maintenance, and related services are provided using reasonable professional judgment.
Plants are living organisms, and Wesleaf cannot guarantee survival, recovery, continued growth, pest elimination, or a particular outcome unless a specific written warranty states otherwise.
Pre-existing pests, disease, root damage, environmental conditions, improper prior care, structural conditions, or other circumstances outside Wesleaf’s control may affect results.
12. Cancellations & Rescheduling
Cancellation, refund, rescheduling, and deposit policies may vary by service or event and will be stated during booking, on the applicable event page, proposal, invoice, or rental agreement.
Where a specific policy is provided for a transaction, that policy governs.
Deposits, custom sourcing costs, special-order products, design fees, and work already performed may be non-refundable as disclosed before purchase.
13. Gift Cards, Promotional Credits & Loyalty Rewards
Gift cards, promotional credits, loyalty rewards, wellness stamps, boutique credits, discounts, and similar incentives are subject to the terms communicated when issued.
Promotional rewards and loyalty benefits have no cash value, cannot be redeemed for cash, and cannot be combined, transferred, or applied retroactively unless Wesleaf expressly permits it.
Wesleaf may establish reasonable eligibility requirements, redemption thresholds, exclusions, or expiration terms for promotional offers, subject to applicable law.
Purchased gift cards will be handled in accordance with applicable law and any terms provided at purchase.
14. Photography & Content
Wesleaf may photograph or record public events, workshops, and experiences for business, educational, archival, and promotional purposes where appropriate.
When photography or recording is planned, Wesleaf may provide notice to participants. Participants who do not wish to appear in promotional content should notify Wesleaf or event staff.
Private-event clients may be asked separately for permission before Wesleaf uses identifiable private-event content for marketing.
15. Website Content & Intellectual Property
Unless otherwise stated, the Wesleaf name, branding, graphics, photographs, designs, written materials, educational materials, website content, and other original materials are owned by or licensed to Wesleaf and may not be reproduced, distributed, sold, modified, or commercially exploited without permission.
Nothing in these Terms restricts a customer's right to provide an honest review or otherwise exercise rights protected by law. Federal law protects consumers from standardized contract provisions that prohibit or penalize honest reviews. Federal Trade Commission
16. Website Availability & Third-Party Services
We work to maintain accurate and accessible website information but do not guarantee uninterrupted or error-free website operation.
Our website may contain links to or integrations with third-party platforms, including payment processors, ticketing platforms, social media platforms, scheduling services, and other providers.
Use of third-party platforms may also be governed by those providers’ terms and privacy practices.
17. Limitation of Liability
To the fullest extent permitted by applicable law, Wesleaf will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, participation in services or events, or use of products.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
18. Indemnification
To the extent permitted by law, users, clients, and renters agree to be responsible for claims, losses, damages, or expenses resulting from their own violation of these Terms, unlawful conduct, misuse of Wesleaf property, or actions of guests or vendors for whom they are legally responsible.
Any additional indemnification requirements applicable to rentals or commercial services will be stated in the applicable written agreement.
19. Privacy
Personal information collected through our website, purchases, bookings, forms, and communications is handled according to our Privacy Policy.
Customers should review the Privacy Policy separately for information about what data Wesleaf collects, how it is used, and applicable choices.
20. Changes to These Terms
Wesleaf may update these Terms periodically to reflect changes in our offerings, business practices, or applicable requirements.
The current version will be posted on our website with the effective or last-updated date.
Changes will apply prospectively unless otherwise permitted or required by law.
21. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where applicable law requires otherwise.
